What happens if you divorce

The Family Court of Singapore will decide whom to grant the 'custody' of the child. The parent who is granted custody of the child has the right to:
(a)
make major decisions concerning the welfare and upbringing of the child,
(b)
have the child live with him/her, and
(c)
make day-to-day decisions concerning the child.

The most important factor in deciding custody and care and control issues is the welfare of the child. 'Welfare' encompasses all aspects of the well-being (includes emotional and physical wellbeing) and upbringing (includes the education and religious and moral upbringing) of the child. The factors considered by the Court include:
-
Conduct of you and your ex-spouse
-
Status quo, i.e. the Court will try as much as possible to preserve the status quo for the child
- Age of the child
- Sibling bond
- Wishes of the parents
- Wishes of the child
